Question:
If a company trades as a Pty Ltd however the entity is a trust (fixed unit trust) are they bound by the Fair Work Act or State legislation? Claims made to Fair Work Australia vs Wageline?
Answer:
The fact that the company is a trustee would not prevent it from having the status as a constitutional corporation and therefore being subject to the Fair Work Act.
